Terms of Service

1. Acceptance of Terms

By creating an account or using the Tot-Time platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Tot-Time provides childcare management tools including attendance tracking, scheduling, menu planning, and related features for childcare providers and administrators. The Service is provided on a subscription basis.

3. Eligibility

You must be at least 18 years old and legally authorized to enter into contracts to use this Service. By using the Service, you represent and warrant that you meet these requirements.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@tot-time.com if you suspect any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account.

5. Subscription and Billing

Access to premium features requires a paid monthly subscription.

  • Recurring billing: Your subscription automatically renews each month on the anniversary of your start date. By subscribing, you authorize Tot-Time to charge your payment method on a recurring monthly basis until you cancel.
  • Cancellation: You may cancel or pause your subscription at any time from your Account Settings page. Cancellation takes effect at the end of the current billing period; you will retain access through that date.
  • Refunds: Subscription fees are non-refundable except as required by applicable law or at our sole discretion.
  • Price changes: We will provide at least 30 days' advance notice of any price change.
  • Payment processing: Payments are processed securely by Square. By subscribing, you also agree to Square's Terms of Service.
6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Share your account credentials with unauthorized third parties
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service
  • Upload or transmit malicious code, viruses, or any content that infringes the rights of others
  • Use the Service in a way that could damage, disable, or impair our servers or networks
7. User Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of the data you enter into the Service. We will not sell your personal data to third parties.

8. Children's Privacy

The Service is designed for use by childcare professionals. You are solely responsible for ensuring that any information you enter about children in your care complies with applicable laws, including FERPA, COPPA, and any applicable state regulations. Tot-Time does not knowingly collect personal information directly from children.

9. Intellectual Property

All content, design, code, and features of the Service are owned by Tot-Time and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our prior written consent.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOT-TIME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO TOT-TIME IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tot-Time and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service or your violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or any reason we deem appropriate. Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination (including limitations of liability, disclaimers, and indemnification) will survive.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Colorado.
